If you are convicted of a felony (or equivalent) your right to have a firearm is automatically removed by the state.  

Contrary to popular belief, receiving an expungement or seal for your criminal record does not automatically restore these rights. 

In most cases, the Governor's Office for the state your offense occurred is the sole authority for restoring rescinded constitutional privileges.

Records Removal Services is a company that assists qualifying individuals in removing their criminal record(s) by either expungement, seal, set-aside, or vacate.  The most important part of this process is government and privately owned criminal database updates; this is not done automatically, it is a process Records Removal Services performs.

 

  Expungement is a process, not an event.  Even after your expungement is granted, it is useless until government and privately owned criminal databases are updated!

 

   In most cases, criminal databases have 180 days to remove your name from their database if a pardon, expungement, seal, or non-disclosure is granted. (see related blog post)

 

 

The process with Records Removal Services

   The process with Records Removal Services begins when you sign-up, you will receive an emailed receipt.  A hyperlink is included with the receipt for requesting additional information from you, the client.  Records Removal Services refers to this information as your "Detailed Case Information."  You will be asked to provide information such as:

  • Name of the state your offense occurred.

  • Name of the county your offense occurred.

  • Your drivers license number.

  • Your date of birth.

  • Confidential comments and information your case manager should be aware of.

Records Removal Services Expungement   After completing your Detailed Case Information, you will receive a packet in the mail from us within 14-20 business days. 

 

Packet items:

  • Letter of Eligibility:  The "Letter of Eligibility" is important if job discrimination (because of your criminal history) is an issue.  The letter carries the seal of Record Removal Services stating that you meet or exceed requirements imposed by the state of your conviction to have your record expunged, sealed, set-aside, or vacated and that you have officially retained Records Removal Services to assist you in this process.

    • We charge a flat fee of $300.00 per state you have a criminal offense to generate all motions, petitions, and notify all government agencies and criminal background check companies.

  • Request for Official Arrest Record:  A form will be included (with detailed instructions attached) for you to obtain a certified, or official copy of your state-wide arrest record (only in the the state the offense occurred). 

Court Motion:   After we receive a certified copy of your arrest record, a motion will be prepared to expunge, seal, vacate, or pardon your record (as appropriate). 

 

Filing:  The motion is then filed with a local court with competent jurisdiction (or the Board of Pardons and Parole, as appropriate).

 

Removal from Databases:  Once the motion is signed by the appropriate court, Records Removal Services begins notifying criminal background check companies that your record has been ordered expunged, sealed, set-aside, or vacated.  Records Removal Services will ensure you are removed from every local, state, and national database, including:  Sheriff's Office, Administrative Office of the Courts, Attorney General, State Bureau of Investigation, State Police, Federal Bureau of Investigation, People Search, Department of Justice, and all private criminal background check companies in the United States.

 

This is the entire process for removing your criminal record. Employers, nor anyone else who runs your name through a criminal database will know you've ever had a criminal history; it will be as if it never occurred.
